Terms of Service

Last updated: September 9, 2026

These Terms of Service ("Terms") govern your access to and use of the BetterVPN website, applications, and related offerings (the "Services"). BetterVPN is owned and operated by BetterLink, LLC, a limited liability company registered in the United States ("BetterLink, LLC," "we," "us," or "our"). By creating an account, downloading our apps, or using the Services, you agree to these Terms and to our Privacy Policy.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

1. The Services

BetterVPN provides encrypted connectivity and related features as described on our website and in our apps including support for multiple platforms (such as iOS, Android, macOS, Windows, and TV clients where available). Features, server locations, and performance may change as we improve the network.

2. Eligibility and accounts

You must meet the minimum age required in your jurisdiction to enter a binding agreement. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.

3. Subscriptions, plans, and devices

Paid access is offered on the terms shown at checkout or in the app store. Eligible new Standard VPN subscriptions may include a 7-day free trial that converts to a paid auto-renewing plan unless you cancel before the trial ends. Dedicated Server and Dedicated IP add-ons are not eligible for the free trial. Plans may limit how many devices can use the Service at the same time (for example, tiers described on our Pricing page). Unless stated otherwise, subscriptions renew automatically where your payment method and platform allow; you can cancel renewal according to the instructions in your account or the app store.

Prices may change for new purchases or renewals with reasonable notice where required by law.

4. Refunds and money-back guarantee

Website payments (Stripe, PayPal, and similar). Eligible new purchases paid on our website through Stripe, PayPal, or other payment methods we process directly are covered by our 30-day money-back guarantee. If you are not satisfied, contact support at [email protected] within 30 days of the charge to request a refund of the eligible purchase amount.

App Store and Google Play purchases. Purchases made through the Apple App Store, Google Play, or another third-party app store are subject solely to that store's refund and billing policies. We cannot issue refunds for those purchases; request them through Apple, Google, or the applicable store.

Free trials are not charged until the trial ends. After a trial converts to a paid subscription, the refund rules above apply based on how you paid. Trial eligibility is limited (for example, one free trial per account, payment method, device, or IP where we detect prior use). Contact support if you believe a charge was made in error.

5. Acceptable use

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Infringe intellectual property or others' rights
  • Send spam, malware, or engage in harassment, fraud, or abuse
  • Attempt to gain unauthorized access to our systems, other users, or third parties
  • Interfere with or degrade the Service for others
  • Distribute lists of our server addresses or probe our infrastructure without authorization

We may suspend or terminate access if we reasonably believe these rules are broken. You are responsible for ensuring that your use complies with laws where you are located; some jurisdictions restrict VPN use.

5a. Prohibited conduct - copyright, P2P, and abuse

The following conduct is expressly prohibited and may result in immediate account suspension, termination, and - where legally required - reporting to the relevant rights holders or authorities:

  • Copyright infringement. Downloading, uploading, streaming, or otherwise reproducing or distributing copyrighted material (including movies, music, software, books, games, and other works) without the authorization of the rights holder is strictly prohibited on all BetterVPN servers.
  • Unauthorized peer-to-peer (P2P) file sharing. Using BitTorrent, eDonkey, Gnutella, or any other P2P protocol to transfer copyrighted content is prohibited on servers that are not explicitly designated as "P2P Allowed." Servers that permit P2P traffic are clearly marked in the BetterVPN app. Use of P2P protocols on non-P2P servers may result in account suspension without warning.
  • DMCA and similar notices. When BetterVPN receives a valid copyright infringement notice (including under the U.S. Digital Millennium Copyright Act or equivalent national law) that identifies your account, we will send a warning email to the address on file. A second substantiated notice will result in suspension. You are encouraged to ensure that a valid email address is associated with your account so that notices can be delivered.
  • Spam and unsolicited communications. Using the Services to send unsolicited bulk email, SMS, or other messages is prohibited.

Servers designated as "P2P Allowed" are indicated by a distinctive badge in the BetterVPN app and are intended only for lawful personal use. Even on P2P-allowed servers, infringing copyrighted content remains prohibited.

6. Software license

We grant you a personal, non-exclusive, non-transferable, revocable license to use our client software solely to access the Services, subject to these Terms. You may not reverse engineer, redistribute, or modify the software except as permitted by law.

7. Third parties

Links or integrations may lead to third-party sites or services. Their terms and privacy practices apply to them, not to us. App store purchases are also subject to the store's terms.

8. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. VPN performance, availability, and routing depend on many factors outside our control. We do not warrant uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, BetterVPN and its affiliates, directors, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for claims relating to the Services is limited to the amount you paid us for the Services in the twelve (12) months before the claim (or, if greater, the minimum allowed by law).

10. Indemnity

You will defend and indemnify BetterVPN against claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services or violation of these Terms, except to the extent caused by our willful misconduct.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, risk to the network, or legal requirements. Provisions that by nature should survive (including disclaimers, limitations, and indemnity) will survive termination.

12. Changes to the Terms

We may update these Terms periodically. The updated version will be posted here with a new "Last updated" date. Continued use after changes constitutes acceptance, except where your consent is required by law.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction we designate for our operating entity, without regard to conflict-of-law rules. Courts in that jurisdiction (or another forum if mandatory consumer law applies) have exclusive jurisdiction over disputes, unless you have a non-waivable right to bring claims elsewhere.

If your region requires a different dispute mechanism (for example mandatory arbitration or small-claims options), those rules apply where they cannot be waived by contract.
